Please be advised that the University recently entered into an agreement on March 31, 2022 with the AAUP-AFT and PTL union to provide Non-Tenure Track (NTT) faculty and Part-Time Lecturers (PTLs) with the option to exclude certain evaluations from NTT promotion and reappointment packets and PTL appointment and advancement decisions. For purposes of implementing this option for eligible AAUP-AFT NTTs and PTLs, please be guided by the following:
AAUP-AFT – NTTs
Requirements and Parameters:
- NTT faculty whose review for reappointment or promotion has been initiated by a department or unit on March 31, 2022 or later have the option to exclude Fall 2020 and Spring 2021 teaching evaluations from promotion and reappointment packets submitted during academic year 2021-2022 or later.
- More specifically, this option applies to: (1) NTT faculty reappointments to the same rank and promotions to the rank of assistant professor and equivalent for academic year 2021-2022 or later governed by the Short Form – Non-libraries (“Short Form”), which are initiated by a department or unit on March 31, 2022 or later; and (2) NTT faculty promotions equivalent to the rank of Associate Professor and above for academic year 2021-2022 or later governed by the Academic Promotion Instructions for NTT faculty (Non-libraries) (“NTT Promotion Instructions (Non-libraries)”), which are initiated by a department or unit on March 31, 2022 or later.
- There will be no retroactive application of this option for NTTs. This option does not apply to NTT faculty whose review for reappointment or promotion has already completed or where review was initiated by a department or unit on a date prior to March 31, 2022.
Implementation:
- NTT faculty meeting the foregoing criteria and who wish to exercise this option, including NTT faculty evaluated on the Short Form, should complete and submit Supplemental Form NTT 1 which is available on the website of the Office of University Labor Relations (OULR) at https://laborrelations.rutgers.edu/faculty/non-tenure-track-faculty-non-libraries.
- The 2021-2022 NTT Promotion Instructions (Non-libraries) and the Short Form have been revised to include this option for NTTs whose review for promotion has been initiated by a department or unit on March 31, 2022 or later.
- The Short Form has been updated with instructions directing eligible NTTs to complete Supplemental Form NTT 1. Please see new language in shaded text on page 1 of the Short Form which may be downloaded from OULR’s website at the same link above.
- The 2021-2022 NTT Promotion Instructions (Non-libraries) have been updated to advise of this new option. Please see new language in shaded text on pages 2, 6, 11 and 13 of the Instructions which may be downloaded from OULR’s website at the same link above.
PTL UNION
Requirements and Parameters:
- PTLs have the option to exclude Fall 2020 and Spring 2021 student evaluations from packets and documents considered by a department or unit relating to PTL appointment and advancement decisions for Fall 2022 or later.
Implementation:
PTLs who wish to exercise this option must notify their Chairs and Deans of their decision via email no later than June 30, 2022. Please use this form to do so by the filing date; PTL Option to Exclude Fall 2020 and Spring 2021 SIRS evaluations.
Faculty may request to exclude AY 2019/2020 from their probationary period and extend it by the same time period excluded due to the COVID crisis.
Requirements:
- This applies to all tenure track faculty who are in a probationary period for tenure as of January 1, 2020.
- For faculty slated to be evaluated for reappointment or promotion on the tenure track in Academic Year 2020/2021, they must submit a written request by no later than May 1, 2020.
- For faculty in a probationary period extending beyond Academic Year 2020/2021, they must submit a written request by no later than May 1, 2021.
- Approval by the chair or dean is required.
- For faculty governed by the University’s agreement with AAUP-AFT, the option of a one-year exclusion is separate from and in addition to exclusions available pursuant to Articles 16 and 17 of that agreement.
- Approval of a request by a faculty member to exclude AY 2019/2020 may not be unreasonably withheld.
Implementation:
- For faculty governed by the University’s agreement with AAUP-AFT, written requests may be submitted via email or other written correspondence to the chair or dean by no later than May 1, 2020 or May 1, 2021, whichever applies. When such request is received and approved, the unit should contact Academic Labor Relations for the preparation of an individual memorandum of agreement (MOA) to be executed by the faculty member and dean.
- If any unit or department contemplates withholding approval of a request by a faculty member to exclude AY 2019/2020, please contact Academic Labor Relations to discuss as approval may not be unreasonably withheld.
Faculty may later opt to withdraw an approved exclusion of AY 2019/2020 due to COVID-19 and proceed with a probationary clock that does not include a COVID-19 exclusion.
Requirements and Implementation:
- This applies to all tenure track faculty who are in a probationary period for tenure as of January 1, 2020, and who were granted an exclusion of AY 2019/2020 due to COVID.
- All such faculty must notify their chair or dean that they opt to rescind the requested exclusion via email or other written correspondence by no later than March 1 of the year in which the faculty member seeks to be evaluated for tenure.
- A withdrawal of the option to exclude shall be without penalty or prejudice to the tenure review.
